The New York Workers’ Compensation Board last week announced changes in the maximum and minimum weekly Workers’ Compensation disability benefits. Claims with accident dates or dates of disability on or after May 1 are now subject to a minimum weekly benefit of $150. The minimum, increased by the 2013-14 New York State budget, was previously $100. Claims with accident dates or dates of disability from July 1, 2013 through June 30, 2014 will be subject to a maximum weekly benefit of $803.21, which is two-thirds of the statewide average weekly wage, up from $792.07. The 2007 Workers’ Compensation reform law permanently indexed the maximum benefit to the statewide average weekly wage.
